The Hon. Principal Judge Advises on One-Sided Interim Orders

The Hon. Principal Judge,\r\nHon. Justice Yorokamu Bamwine warned High Court Registrars against entertaining\r\none-sided interim order applications (legally called ex-parte orders) in order\r\nto avoid future embarrassments by the Judiciary.

In a memo to all Registrars,\r\nHon. Justice Bamwine, the administrative head of the High Court, noted that\r\nthere is a growing ‘notorious’ trend by these officers to hurriedly entertain\r\nex parte interim applications, a move he says is improper.

Hon. Justice Bamwine noted that the\r\none-sided interim orders usually leave the other party that was not involved in\r\nannoyance as they are condemned unheard and yet the natural rules of justice\r\ndemand that no one should be condemned unheard.

The Principal Judge was, however, was quick\r\nto give a green light to the Registrars to issue interim orders only to\r\nmaintain the status quo in a short time pending the disposal of a temporary\r\ninjunction before a judge. He further warned that in such circumstances, Registrars\r\nare mandated to act judiciously.
